How Do I File a Writ

We do not file Writs for Possession automatically, but rather we file them after you have submitted a Writ of Possession Request by email after judgment for possession has been granted. That way, you will not be charged Court Costs and our service fees for a Writ that you might not have needed.

If you need a Writ of Possession, send us an email and the case will move to your Writ Filed section. A member of our Team will then prepare and e-file the paperwork with the Court, and pay the court costs for you. What this means for you is that for all Writ requests received by noon, we will do our best to get the Writs processed and to the Clerk within 24 business hours. We will electronically submit your Writ to the court for filing.

Electronic Filing Counties — After you win possession, you will receive an automated reminder to come back and request any Writs that are needed. Writs are not prepared automatically, so be sure to come back and specifically ask us to prepare those that are needed. When you do, we prepare and file the Writs. After the Clerk receives the paperwork for the Writs of Possession you requested, they will process and forward them to us. This can take a few days to a week. Once you receive the Writs from the Clerk, you may take them to the Sheriff along with their Information Form, Electronic Writ Declaration, and a check or cash for $145.00. The Sheriff will post a final 5-day notice on the property. The Sheriff should contact you or your agent directly to schedule a lockout. If you have not heard from the sheriff within 3 days of submitting the writ, please contact the sheriff directly. In-Person & Fax Filing Counties — After you win possession, you will receive an automated reminder to come back and request any Writs that are needed. When you do, we prepare the Writ of Possession and overnight it to the Clerk of Court in your jurisdiction. After the Clerk receives the paperwork for the Writs of Possession you requested, they will process and forward them to you by mail. This can take a few days to a week or so. We recommend calling the clerk 48 hours after you they have received it overnight. NOTE: In a small number of counties in California, the clerk may require you to come by the courthouse and personally pick the Writ. Please contact your eviction service manager to verify the time constraints for your specific county. Once you receive the Writs from the Clerk, you may take them to the Sheriff along with their Information Form and a check or cash for $145.00.
